Frequently Asked Questions about Criminal Defense in Princeton, NJ

Will I have to be in jail while I am awaiting trial on my charges?

Whether the trial court decides to release you pretrial or to order pretrial detention for you will depend on various factors, including the severity of your present offense, your prior criminal history, and the likelihood of you returning to court for trial and all other required appearances. If the trial court releases you pretrial, it may impose various conditions on your release, such as not leaving the state, maintaining employment, and avoiding arrests for new crimes. However, for certain offenses, there is usually a presumption in favor of pretrial detention, including homicide, aggravated assault, burglary, crimes involving a firearm, and other violent offenses.

I am innocent of any crime. Can the police still arrest me?

Even if you are ultimately acquitted or exonerated of a charged crime, there may be sufficient evidence to give law enforcement probable cause to believe that you committed the crime. You should never try to “talk your way out” of an arrest, as you may end up saying something that is later used as evidence against you. You should also never try to flee or avoid arrest, even for a crime you are innocent of since resisting arrest is itself a crime.
